Right-of-way/Easement Vacations
SUBMITAL REQUIREMENT FOR A
RIGHT-OF-WAY/EASEMENT VACATIONS
The applicant must provide all the following information before Engineering will begin processing a request to vacate a right-of-way or easement.
- A complete and accurate legal description and drawing of the right-of-way or easement to be considered for vacation.
- Signatures of any and all property owners affected by the vacation.
- Signoffs from the utilities approving the vacation. These include but are not limited to power, phone, cable, sewer, water, etc.
- A complete and accurate legal description and drawing of how the right-of-way or easement will be equally split among the properties adjoining the vacated right-of-way or easement.
- Fees
Once all these items are submitted, the Engineering Department will start processing the application.
The Board will consider but not be limited to the following criteria when reviewing the vacation request:
- The easement can be vacated without adversely affecting any existing roads and/or utilities.
- The easement can be vacated without adversely affecting future improvements to existing or future roads and/or utilities.
- The vacation will not eliminate access from private properties to public rights-of-way or easements.
The applicant must be aware of the fact that Summit County is under no obligation to vacate rights-of-way or easements that are under Summit County jurisdiction.
